GENERAL SUBSCRIPTION CONDITIONS
3 Vallées Liberté Pass
The following general conditions detail the relationship between the 3 Vallées lift companies (hereafter called the Manager and each Subscriber (hereafter the Subscriber) and Beneficiary (hereafter the « Beneficiary ») of the 3 Vallées LibertyOffer.
ARTICLE 1. Definitions
Subscription: refers to the subscription to the 3 Vallées Liberty
Subscriber: refers to a person, over the age of majority and legally responsible, who subscribes to the 3 Vallées
Beneficiary: refers to the person who owns a 3 Vallées Liberty Cardand benefits from a 3 Vallées Liberty Pass
Card : refers to the « 3 Vallées Liberty» Card, the physical support for the 3 Vallées Liberty Passin the form of a RFID microchip card, nominative, personal and non transferable, giving access to the 3 Vallées ski lift system.
Number of days used: the number of skiing days used by the Beneficiaries over a given period.
Subscriber's account: refers to the account regrouping all the Beneficiaries attached to the Subscriber, accessible on the Internet Site and allowing the Subscriber to access, after having been identified, all the information relative to his Subscriptions, Number of days used by the Beneficiaries of the account, to the Services, his bills and personal details.
Ski area : the exterior perimeter of the ski lift system.
Manager (s) : the 3 Vallées ski lift company (or companies) as mentioned in article 4.
Ski lift system: all the ski lifts in the 3 Vallées ski area managed by the Managers, and accessible by the Beneficiaries.
Resort's Internet Site : refers to the site of the Company who issues the 3 Vallées Liberty Card.
Client Service: refers to the information and help service available to the Subscribers and Beneficiaries under the conditions defined on the Internet Site.
Issuing Company: the ski lift company who sells the 3 Vallées Liberty Card.
Services : refers to all the complementary services on offer by the 3 Vallées ski lift companies such as those described on the Resort's Internet Site, and detailed in the Special Sales Conditions relative to each service.
ARTICLE 2. Description of the 3 Vallées Liberty skipass
The 3 Vallées Liberty is a subscription offering beneficiaries the possibility to access easily, quickly and in a aleatory manner, using a “hands free” system, and at the 3 Vallées Liberty day's tariff, all the Ski area of the 3 Vallées' system such as those mentioned below (hereafter called the Ski Area(s)).
After subscription to the 3 Vallées Libertya Card is issued, which gives the beneficiaries the right to pass through the turnstiles of the 3 Vallées ski system and with unlimited access during the validity of the Subscription and limited only by the Ski Areas being open. In addition, the Subscriber benefits from a “weekly” bill giving the amount of days skied by the Beneficiaries of his Subscriber's Account.
ARTICLE 3. Issuing Company
The company who sells the 3 Vallées Liberty Card is hereafter called the Issuing Company.
ARTICLE 4. The 3 Vallées ski lift system
The Card gives free circulation on all the ski lifts of the following Ski Areas, managed by the following Companies, whose headquarters are :
-The 3 Vallées Company,
Ski Lift management company for the Courchevel Valley ski area.
-The 3 Vallées Company, Mottaret (S3V Mottaret) a Limited Company with a Board of Directors and
Supervisory Board with a capital of 73 865 940 €, registered with the RCS in Albertville under the n°429 852 668, and whose head office is at La Crois ette 73120 Courchevel,
represented by the Chairman of the board, Monsieur Claude FAURE, Ski Lift management company for the ski area of Mottaret
-The Vallée des Belleville ski lift company (SEVABEL), a Simplified stock company with a Board of Directors, with a capital of 3.235.500 € and whose head office is at SAINT MARTIN DE BELLEVILLE –
73440 LES MENUIRES, registered with the RCS in Albertville under the number B 353 065 964, represented by the Managing Director, Monsieur Pascal ABRY,
Ski Lift management company for the Les Menuires - Saint Martin de Belleville ski area.
-The MERIBEL ALPINA Company, a Simplified stock company, with a capital of 3.287.169 €, registered with
the RCS in Albertville under the number B 075 520 064, and whose head office is at Méribel les Allues 73550, represented by the Managing Director, Monsieur Olivier SIMONIN
Ski Lift management company for the
-The Tarentaise and Maurienne Cable Car Company (SETAM), a Limited Company with a Board of Directors, with a capital of 4.318.905 €, and whose head office is at
Ski Lift management company for the Val Thorens ski area (excluding Orelle) .
-The Orelle Cable Car Company (STOR), a Limited Company with a Board of Directors and Supervisory Board with a capital of 780.000 €, and whose head office is at FRANCOZ – 73140 ORELLE , registered with the RCS in Albertville under the number 402 811 061, represented by the Chairman of the Board, Monsieur Robert GUILLERMET, Ski Lift management company for the Orelle ski area (excluding Val Thorens).
It is thus agreed that the Ski Areas concerned by the 3 Vallées Liberty card are:
-The ski area of the Courchevel Valley managed by S3V
-The ski area of the Méribel Valley (Méribel+Méribe Mottaret) managed jointly by S3V Mottaret and Méribel- Alpina
-The Les Menuires - St Martin ski area managed by the SEVABEL
-The 3 Vallées ski area managed jointly by S3V
Depending on the Ski Areas used, for the season
-Courchevel Valley 1 day ski pass
-Méribel Valley 1 day ski pass
-3 Vallées 1 day ski pass
Exceptional reduction all Saturdays of the winter season : 20% on the 3 Vallées 1 day ski pass.
Furthermore, as well as the conditions below, the 9th day of skiing is free of charge as is every sixth day after that.
These tariffs correspond to the public adult one day tariffs posted in the ski pass offices of the 3 Vallées management companies, and on which the reductions will be deducted. These tariffs and reductions may be modified, notably when the Subscription is renewed.
The 3 Vallées Liberty Pass must meet the general sales and uses conditions of each resort.
Certain additional reductions (on Saturdays, for example), may also apply. For more information, consult the managing companies internet sites.
The limits of the ski area are shown on the the piste maps edited by each ski lift company. l
ARTICLE 5. Subscription
The Card is issued by an Issuing Company only on its Internet Site.
Subscriptions are taken out by the Subscriber for the account of a Beneficiary, of which the Subscriber may be one. The Subscriber may take out several Subscriptions for the account of several Beneficiaries up to a maximum of six
By taking out a Subscription, the Subscriber accepts the present general Subscription conditions as well as the general sales conditions and conditions of use for the Manager's ski lifts.
The Issuing Company is free to refuse a Subscription application for a legitimate reason, such as known insolubility or the cancellation of a precedent Subscription by one of the companies mentioned in Article 4 for fraud or non payment.
The Subscriber is invited to conserve a copy of his order confirmation, as well as an example of the present general Subscription conditions (either electronically or on paper).
After the Subscriptions and their payment have been validated, the Issuing Company will send the Subscriber a welcoming electronic letter
o of the creation of his bill and his dedicated area,
o the postal date or availability of the Card(s) in one of the 3 Vallées LibertyIssuing Company's sales points.
Under article L.
If the Subscriber exercises his right to retract under the conditions above, he can request the reimbursement of the Subscription fee(s) already paid. The reimbursement will take place within a delay of thirty (30) days following the date that the retraction was received.
If any of the Beneficiaries of the Subscriber's Account use skiing days before the delay is up, the Subscriber can no longer exercise his right to retract the Subscription concerned, in accordance with article L.
ARTICLE 6. Subscription validity period
The Subscription is taken out for a period from 1st November of year n, to 31st October of n+1, whatever the date of the subscription.
The Subscription is renewed tacitly under the tariff conditions on the day of the renewal. The Subscriber will be informed by electronic post, 1 month before the expiry date of his Subscription(s), about the conditions applicable for the renewal of the Subscription(s). He will thus have until 31st October of that year to notify the
If no notification is received from the Subscriber, the Subscription(s) will be automatically renewed for a period of 12 months from 1st November each year.
The renewal payment for the Subscription(s) is payable on 1st November each year.
ARTICLE 7. Tariffs and means of payment
Every issued Card implies payment of a Subscription. The relevant amount is available on the Resort's Internet Site.
The daily 3 Vallées Liberty tariffs for the Ski area's ski lifts, are fixed by each of the Ski Lift managers and billed to the Subscriber according to the tariff conditions applicable on the date that the pass is used.
The subscriber is informed that when a Beneficiary passes through a turnstile giving access to a Ski Area's ski lifts, he will be billed for a day's 3 Vallées Liberty tariff, irrespective of the number of passages effectuated during that day.
The day's 3 Vallées Libertytariff for the Ski area, is billed by the Manager of the ski area used, or, for all ski areas, jointly by the 3 Vallées Liberty Card Issuing Company.
The daily 3 Vallées Liberty tariffs for the Ski Areas are available on the Resort's Internet Site. These tariffs correspond to the public adult daily tariff posted in the ski lift offices of the 3 Vallées ski lift companies, with the relevant reductions. These tariffs and reductions may be modified, notably when the Subscription is renewed.
The 3 Vallées Libertytariffs are not cumulative with other reduced tariffs, in particular child, senior, family tariffs …
7.2. Means of payment
The Subscription fee and the resulting use of the Beneficiaries of the Ski Areas, are payable by credit card. On Subscription, the Subscriber will give his numbers, validity date and the security number of his credit card (the transaction takes place on a secure site). This payment order by credit card is given by the Subscriber for all the payments concerning his 3 Vallées Liberty subscription, both for its use and any additional Services. The information will be conserved by the Issuing Company for future payments.
The debits will be effectuated either directly by each manager, or via the
The sums due are payable on the date indicated on the bill.
Debits may be effectuated by other managers of the 3 Vallées other than the Issuing Company, depending on the Ski Areas used, as detailed in article 4.
7.3. Billing and the Subscriber's Account
Every week, the Issuing Company will establish the list of skiing days for the past week used by the Beneficiaries of the Subscriber's account, on the ski area. The calculation of the skiing days effectuated per week is based on the 3 Vallées Liberty tariff applicable for the Ski area concerned, irrespective of the number of passages and whether the Beneficiary has skied on all or part of the Ski Area.
The number of days will be sent by email, with details, for each Beneficiary, of the amount to be debited for each subscription.
To have the exact details of the passages, the Subscriber can connect to his Internet account thanks to a login/password sent by the Issuing Company in the first few days after the 3 Vallées LibertySubscription has been taken out..
Based on the list of days skied, every week the Issuing Company and/or the manager will bill and debit the Subscriber's credit card of the sums due by him for this week. He is considered as responsible for each of the Beneficiaries of the Subscriber's Account and, if appropriate, for any other sums due by the Subscriber under the terms of his Subscription.
The bill cannot be considered as a final bill for the Beneficiaries passages on the ski areas ski lifts during the relevant period. All skiing days omitted from this bill will be billed later, within the date limit of the current season.
The number of skiing days registered by the Issuing Company's and/or Manager's computer system, which serves as a base for the bill, is deemed correct unless proven to the contrary.
The bill will indicate :
·the price (all taxes included)
·the date of the bill and the date of payment
·The ski area used by the Beneficiaries of the Subscriber's Accounts
·Any other Services used
·Any eventual indemnities, penalties or costs incurred under articles 7.4, 10 et 11.
The Subscriber authorises the Issuing Company and/or the manager to send him these bills electronically. The Subscriber will receive, in each electronic letter
The bills will be debited from the Subscriber's credit card on a weekly basis.
If the payment for a bill is refused, the Issuing Company and/or manager may reissue another bill depending on why the initial payment was refused. In this case the Subscriber will receive a second bill by
In addition, if the Subscriber does not pay the sums due within a delay of 15 days following the second bill, and without a serious query about the sums billed and about which the main Subscriber has informed the Issuing Company and/or the manager, the cancellation of the Subscription(s) of the Subscriber's Account will be effectuated without any further notice. All the skiing days not yet billed become immediately due.
Any costs involved in the collection of sums due, are payable by the Subscriber.
ARTICLE 8. Conditions of use for the Card
The Card is non reimbursable and non exchangeable. The Card remains the exclusive property of the Issuing Company.
The Card gives the Beneficiary the right, during its validity period, to unlimited circulation on the 3 Vallées Ski lifts. The Beneficiary must carry his Card with him at all times when he uses the ski lifts, from the bottom of the lift to the top.
Access to the Ski Lift System is exclusively given on presentation of the Card at the turnstiles and depends on the respective opening hours of the ski lifts. If the Card is not presented at the turnstile, the access to the ski lifts will be refused. In no case will the Manager and/or Issuing Company reimburse any purchases of ski passes by the Subscriber and/or a Beneficiary resulting from the Card being forgotten, lost or stolen.
Controls of the card and its carrier may be carried out by official controllers so as to verify that the Card is being used for personal use only. The non respect of the personal character of the Card will result in the immediate confiscation of the card and cancellation of the Subscription.
ARTICLE 9. Modification of the details of the Subscriber and/or a Beneficiary
If the postal address, email address and/or bank details change, the Subscriber must inform the Client Service about the changes within a maximum of 5 days following the change.
The modification will take effect a maximum of 8 days after reception of the notification, by the Client Service, of the modifications. The modification will be immediate if the modifications are notified directly on the Internet Site or by telephone.
ARTICLE 10. Loss or theft of the Card
If the Card of a Beneficiary is lost or stolen, the Subscriber or Beneficiary must inform the Client Service as soon as possible, either by telephone or via the Internet Site.
In addition, the Subscriber or the Beneficiary must declare the loss or theft in one of the Issuing Company's Ski pass sales points. The Card will then be cancelled and cannot be reused.
For all new issues of a Card, the Subscriber must apply to the Client Service. The Subscriber is informed that dossier fees of 10€ will be billed and paid by him directly on his account as a participation in the replacement card costs.
The Issuing Company will give the new Card to the Subscriber. The new Card can also be given directly to the Subscriber or Beneficiary in one of the Issuing Company's 3 Vallées Liberty Sales points, if the loss or theft was declared on site.
If the Subscriber finds the Card that has been declared loss or stolen, he must return it to the Issuing Company by recommended post.
ARTICLE 11. Faulty Card
If the Card dysfunctions or has a technical problem, the Issuing Company will, as soon as possible and with all costs paid by them, replace the faulty Card (in return for) and counting from when the faulty card is returned.
However, if, after verification, the Card is faulty due to the Beneficiary, the Issuing Company will bill the Subscriber the amount of 10€ towards the cost of the replacement card.
The faulty Card will be replaced by the Issuing Company who issued the initial card.

ARTICLE 13. Cancellation
13.1 Cancellation by the Subscriber
The Subscriber may request, at any moment, the full cancellation of his Subscription from the Client Service by recommended letter. The Subscriber must give his contract references : full details, number of his Subscriber's Account and the number of the Card(s) returned. When the cancellation request is received, the Issuing Company will send an electronic cancellation confirmation (it is recommended to keep a copy of this confirmation), and he will cancel the Card(s) of the Subscriber's Account and the Beneficiaries of the Account will no longer be able to benefit from the advantages of the Card(s) unless they sign up for a new subscription.
The cancellation will take place on the date indicated by the Subscriber when he send the notification, and at the earliest, or if no date is indication, two (2) working days after the cancellation notice is received.
The cancellation of the Subscription by the Subscriber does not give the right to any reimbursement for the Subscriber, nor to any indemnities. A confirmation will be sent by electronic mail to the Subscriber. The skiing days used after the cancellation date as defined above, are due by the Subscriber.
13.2 Cancellation by the Issuing Company
The Issuing Company retains the right to cancel, in full, the Subscription(s) before the renewal date and to cancel the Card(s) if the Subscriber and/or one of the Beneficiaries of the Subscriber's Account does not respect one of the obligations to which they are liable under the terms of the current general Subscription conditions and/or the general sales conditions and conditions of use of the managers' ski lifts, notably in the case of :
·fraudulent or false declarations: false declaration or false documents when the Card is issued or reissued
·violation of the present general Subscription conditions and the general conditions of use of the Ski Area lift system and any comportment contrary to public order and normal behaviour.
And this, without the Subscriber being able to request any form of reimbursement, even partial, or any form of damages for this prejudice.
The Managers reserve the right to refuse all subscriptions which have already been subject to a cancellation by one of the five Managers.
The Subscriber and/or the Beneficiaries will be informed by email that their card has been invalidated and informed the reasons for this invalidation.
ARTICLE 14. Results of the cancellation
14.1. Return of the Card
If the subscription is cancelled, for whatever reason, the Subscriber must return the invalid Card(s) in his possession and/or in possession of the Beneficiaries of the Subscriber's Account to the Issuing Company.
14.2. Unpaid sums
If the subscription is cancelled, for whatever reason, the Issuing Company and/or manager will bill the unpaid sums due for the Subscription, including the skiing days used. To these sums, if appropriate, will be added any late payment fees and charges as detailed in article 7.
ARTICLE 15. Complaints
All complaints must be sent via the Internet Site using the Subscriber's Account or directly to the Client Service within 15 days following the event to which the complaint relates.
ARTICLE 16. Computer data information and liberty
The information collected by the Issuing Company when the Subscriber subscribes are obligatory and indispensable for the issue of the Card.
This information is destined for use by the Issuing Company, responsible for the treatment, for administrative and commercial purposes, as well as for the Managers and other service providers and all third parties involved in the management and execution of the current Subscription.
The postal addresses and electronic addresses (email) of the Subscriber and the Beneficiaries are liable to be communicated to commercial partners.
To this effect, the Subscriber and the Beneficiaries are informed that they may receive offers from these organisations and companies. The Subscriber and the Beneficiaries who accept that their personal information is communicated under the conditions mentioned above, should tick the relevant box when they take out their Subscription.
In conformity with the law concerning computer data information and liberty dated 6th January 1978 the Subscriber and Beneficiaries have a right to oppose, modify, correct and eliminate data which concerns them. They can exercise this right by contacting the Client Service.
ARTICLE 17. Intellectual Property Rights
The Subscriber has no property or usage rights and cannot use the names, signs, emblems, logos, brands, authors rights and any signs or other rights whether literary, artistic or industrial of the Issuing Company and/or the Managers.
ARTICLE 18. Other Clauses
The Issuing Company retains the right to modify the current general Subscription conditions. These modifications will be notified by electronic post (email) to the Subscriber one month before they take effect, except when they concern modifications to the tariffs giving access to the Ski Area's ski lift system, as these will be immediately applicable. If these changes are refused by the Subscriber, he must cancel his Subscription under the conditions defined in article 13 above.
In the case that the present general Subscription conditions are translated into several languages, it is expressly understood that only the French version of the present general Subscription conditions is the correct version. In consequence, and should there be any difficulty in interpretation/application of one of the dispositions in the present general Subscription conditions, the French version should be purposefully and exclusively referred to.
The present general Subscription conditions are covered, both for their interpretation and for their administration, by French law. Should no amiable agreement be found, the differences will be heard in front of the relevant Law Courts.
